Par tiesiskās aizsardzības procesa plānu

Ar Vidzemes rajona tiesas 2019.gada 18.jūnija lēmumu tika pieņemts AS VALMIERAS STIKLA ŠĶIEDRA (turpmāk tekstā – “Sabiedrība”) pieteikums par tiesiskās aizsardzības procesa (“TAP”) lietas ierosināšanu un ierosināta Sabiedrības tiesiskās aizsardzības procesa lieta.2019.gada 19.septembrī Sabiedrība Vidzemes rajona tiesā iesniedza pieteikumu par TAP pasākumu plāna apstiprināšanu un TAP īstenošanu.2019.gada 18.oktobrī Vidzemes rajona tiesa nosprieda:Īstenot Sabiedrības tiesiskās aizsardzības procesu;Apstiprināt Sabiedrības tiesiskās aizsardzības procesa pasākumu plānu 2019.gada 5.septembra redakcijā;Noteikt Sabiedrības tiesiskās aizsardzības procesa īstenošanas termiņu divus gadus, termiņu skaitot no 2019.gada 18.oktobra.Lai sekmīgi īstenotu Plānu un sasniegtu TAP mērķi, un, proti, – atjaunotu Sabiedrības spēju nokārtot savas saistības, Sabiedrība TAP laikā piemēros šādas metodes:Nodrošināto kreditoru grupā:Sabiedrības maksājumu saistību (kreditoru Galveno prasījumu) daļēja izpildes atlikšana;Sabiedrības maksājumu saistību (kreditoru Blakus prasījumu) dzēšana;Sabiedrības kapitāla daļu ASV meitas sabiedrībā un/vai tās mantas atsavināšana un/vai finanšu līdzekļu piesaistīšana no trešajām personām;Vienošanās noslēgšana ar Nodrošinātajiem kreditoriem par daļēju maksājumu saistību izpildes atlikšanu uz laiku pēc Plāna izpildes.Nenodrošināto kreditoru grupā:Sabiedrības maksājumu saistību (kreditoru Galveno prasījumu) izpildes atlikšana un sadalīšana maksājumos uz laiku līdz 24 mēnešiem;Sabiedrības maksājumu saistību (kreditoru Blakus prasījumu) dzēšana;vienošanās noslēgšana ar LBBW Banku par maksājumu saistību sadalīšanu maksājumos uz laiku līdz 48 mēnešiem;Apliecinājumu saņemšana no atsevišķiem nenodrošinātajiem kreditoriem (saistītām personām) par maksājumu saistību izpildes atlikšanu uz laiku pēc Plāna izpildes.Nodrošināto un nenodrošināto kreditoru grupā:Sabiedrības apņemšanās nodrošināt tai papildus finanšu līdzekļu pieejamību EUR 5 000 000 apmērā.Sabiedrība ir pateicīga visiem kreditoriem par izrādīto sapratni un atbalstu TAP pasākumu plāna īstenošanāSabiedrība veiks tās kreditoru informēšanu par Sabiedrības darbības rezultātiem likumā noteiktajā kārtībā, kā arī nosūtīs kreditoriem ikmēneša Sabiedrības darbības pārskatu par TAP īstenošanas gaitu.Pielikumā – tiesas apstiprinātais tiesiskās aizsardzības procesa pasākumu plāns.AS VALMIERAS STIKLA ŠĶIEDRA valdePapildu informācija:
