Correction: Dėl teisminio proceso prieš UAB „GetJet Airlines“ dėl užsakomųjų skrydžių sutarties

AB „Novaturas“ (Bendrovė) praneša apie Vilniaus apygardos teisme priimtą nagrinėti AB „Novaturas“ ieškinį su UAB „GetJet Airlines“ (GetJet) dėl užsakomųjų skrydžių sutarties vykdymo.Bendrovė su GetJet yra sudariusi užsakomųjų skrydžių sutartį, kurios pagrindu Bendrovė užsako, o GetJet vykdo užsakomuosius skrydžius Bendrovės organizuojamų kelionių kryptimis (Užsakomųjų skrydžių sutartis). Dėl 2020 metais visame pasaulyje susiklosčiusios pasaulinės COVID-19 (SARS-COV-2) pandemijos Užsakomųjų skrydžių sutarties vykdymas yra paveiktas nenugalimos jėgos (force majeure) aplinkybių, todėl sutartis yra vykdoma ne visa apimtimi.Pandemija lėmė tai, kad tarp Bendrovės ir GetJet atsirado teisinis neaiškumas dėl sutartinių įsipareigojimų apimties vykdant Užsakomųjų skrydžių sutartį. Šiam neaiškumui išspręsti Bendrovė iniciavo teisminį ginčą, kuriame prašoma konstatuoti, jog Užsakomųjų skrydžių sutartis negalėjo būti įvykdyta visa apimtimi dėl nenugalimos jėgos aplinkybių. 2020 11 20 Bendrovė buvo informuota, kad Teismas šį ieškinį priėmė 2020 11 19. Ieškinyje Bendrovė taip pat prašo teismo išspręsti tarp sutarties šalių susiklosčiusį teisinį neapibrėžtumą dėl Užsakomųjų skrydžių sutarties vykdymo ateityje, ir sutartį pakeisti taip, kad jos sąlygos atitiktų iš esmės pasikeitusias sutarties vykdymo aplinkybes, sumažinant numatytų skrydžių apimtis. Šio ginčo išsprendimas nustatys, kokią įtaką Užsakomųjų skrydžių sutarties vykdymui turi nenugalima jėga, ir sureguliuos Bendrovės ir GetJet tarpusavio įsipareigojimus. Konstatavus, kad Užsakomųjų skrydžių sutartis visa apimtimi negalėjo būti vykdoma dėl nenugalimos jėgos aplinkybių, Bendrovė tikisi išvengti galimų sutarties netesybų mokėjimo, kurias GetJet gali apskaičiuoti.Tomas Staškūnas
